Burress will be indicted

Posted by Mike Florio on August 3, 2009 1:49 PM ET

ESPN reports that receiver Plaxico Burress will be indicted on felony weapons charges arising from the November 2008 incident in a Manhattan nightclub, during which Burress accidentally shot himself with a gun he was toting in the waistband of his sweatpants.

The move means that Burress will, absent a plea bargain, face a trial.

No date has been set; his lawyer, Benjamin Brafman, previously has indicated that his calendar prevents him from being available until March 2010.

The next question is whether Commissioner Roger Goodell will suspend Burress indefinitely until the case is resolved and any jail term is served.

Two years ago, Goodell did just that with quarterback Mike Vick.

This has to be one of the worst career moves since McLean Stevenson left M*A*S*H. Burress could have copped out, did the three months, paid the price, thrown himself at The Commish’s mercy, probably gotten a 6 game suspension, and been ready to play for someone during the stretch run.

Instead, he turned down the offer, and could conceivably lose it all.

Maybe he can be in the Riker’s Island Production of “The Longest Yard:The Musical”

Agreed.

For me, winning isn't something that happens suddenly on the field when the whistle blows and the crowds roar. Winning is something that builds physically and mentally every day that you train and every night that you dream.

AP

Thank god he was not indicted. I understand that the fact-finding mission was to be as all-inclusive as possible; however, I’m very excited that AP was able to avoid anything further with this trial.

I’m so happy that this distraction is no longer a NY Giants issue.

The one person whose reaction I’d love to see is Drew Rosenhaus’ – that smug POS must be sweating right now.

Additionally, I can’t say that I actually feel bad for Plax – I agree with everything Jim said above. Had he copped out, he’d be in training

I really hope Goodell is consistent and suspends Plax until his case is resolved.

+1

that’s a huge relief. AP has been the only consistent LB the giants have had the past 3 or so seasons.

good job cutting him before this happened

I agree with you..Cody K

Thank God they didn’t indict AP..It would have been wrong and unjust…Now he can concentrate on his job..He did the right thing for a friend..As for Plax, yes he should have took the medicine they offered him, but he refused…Now it looks like he is in really deep deep yogurt…As smart as he is on the field, he is equally dumb off of it.

Jim and Cody

I thought the news early last week said he had never been offered 3 months, only two years?

Anyone remember that play AP made...

In the NFC Championship game at Green Bay…when he sniffed out that screen, took on THREE linemen and still made the tackle. Saved a sure TD…one of the most underrated plays of the year if you ask me.

"We'll show up tomorrow and do the same thing we try to do every day, Kick Pedroia's ass in cribbage and try and win a baseball game."

.

I heard the same as Queler…i don’t think they ever had a deal on the table for 3 months…just two years and plax was trying to only do a year.

and Tito, yes i remember that play well, AP save us big time with that one….

while we’re talking about LB i would love nothing more than to see Chase line up over at SAM instead of Clark until Sintim is ready to take over…i thought a big reason why AP got burned last year was the last of help at SAM. I mean, the guy can’t cover the entire field can he???

I would be happy to see Chase (SAM), AP (MIKE), and Kehl (WILL) come week 1.

that’s supposed to read “Lack of help” not “last of help”

I had thought Plax was terminally stupid for passing on 3 mos. in the pokey ...

when that was the rumor a few months back (and word was he was refusing to do any time). That is so far off of DA wants 2 yrs. and Plax willing to do 1. Don’t know which to believe.

In any event, he looks to be screwed. Goodell may well ban him for 2009, and if he does 2 yrs. after trial … career over. Amazing. Also not mentioned much, is he likely had a rather high blood alcohol content that night (remember the strip club before the dance club ?). Makes carrying a loaded weapon all that more reckless. That might factor into both Goodell’s and the jury’s decision.

What a waste

I want to say that hopefully someone will learn from Plaxico’s mistake but it always seems though no matter how many times athletes get in trouble with the law other athletes just never seem to learn.

The DA

definitely had a hard on for this case…not only did Bloomberg open his mouth about it but I believe this is the last year for the DA in NY (Morgenthau or whatever his name is)…he’s basically stepping down so who knows, maybe this was his way of “going out with a bang?” if that even makes sense.

but john W hit the nail on the head….what a waste is right…i mean, you caught the winning TD in a super bowl, your team re negotiates your contract, your team has a nucleus of players to get you in the playoffs for the foreseeable future and this is how you want to play your cards????

honestly it’s sad…and i know this didn’t have any bearing on the case but disrespecting the giants was the last thing he shoulda done…i mean, you saw the way Mara when to back for AP…i didn’t see any statements concerning Plaxico…wonder why that was…lol

Could it be ...

that when Plax still was a Giant, the offer was 3 mos. jail time, and when he acted like a childish ingrate and talked his way out of NY, the staff of the Manhattan DA’s office had no more incentive (as Giants fans) to give him a sweet plea deal, and it became 2 years ?

by Shofner85 on Aug 3, 2009 5:20 PM EDT reply actions   0 recs

Definitely

But plax was stupid and didn’t want to do any jail time. He’ll be lucky to do a year

by Willgfass on Aug 3, 2009 5:29 PM EDT up reply actions   0 recs

He'll be lucky ...

to have any career left at all. Very sad, yet he is a very unsympathetic “victim”.

if he signed with the Jets

his plea deal was gonna jump to 5 years. If he signed with the Cowboys, his plea would have jumped to life, with the DA pushing for capital punishment.

Cody K

I agree with you almost 100 percent. Except Drew Rosenhaus has so many clients that he most likely makes more than all of them. Happy that AP is in the clear. As far as Burress goes, well its kind of a shame he was a monster for us in that magical year, but the NFL is a what have you done for me lately league, and he is no longer our problem so.

by wangstu13 on Aug 3, 2009 11:24 PM EDT reply actions   0 recs

Later...

Burress put it upon himself. And with a terrible DA decision to try his sob case against a jury they want to give him the max now. That’s exactly what his hard head deserves.

For me, winning isn't something that happens suddenly on the field when the whistle blows and the crowds roar. Winning is something that builds physically and mentally every day that you train and every night that you dream.
