BREAKING NFL NEWS: Plaxico Burress accepts plea deal, will spend 2 years in jail
According to the New York Daily News, Plaxico Burress has accepted a plea deal, and will spend two years in jail.
Highlights:
Ex-Super Bowl hero Plaxico Burress accepted a plea bargain Thursday that will land the talented but troubled wide receiver behind bars for two years.
The agreement with the Manhattan district attorney came nine months after Burress, 31, shot himself through the thigh with an illegal .40-caliber Glock inside a crowded nightclub.
I am stunned. I never in a million years expected him to do anywhere near this much jail time.

I too am shocked. I expected a slap on the wrist w/ big fines, some probation & maybe a little community service. Definitely did not see him getting 2 yrs in jail.

This is a pretty dumb act ( the shooting himself and shooting down his career too after refusing pleas that would have made his jail sentence almost done by now….), but it just seems senseless to lock the guy up (for just about the same length as the guy that oversaw the torturing and killing of hundereds of dogs).

The first words out of my mouth were “He’ll never play another game in a Giants uniform.”

I think
if he’d worked out a plea at an earlier stage he might have gotten less time.
But the more this lingered and he fought the system, the more the system wanted to make an example of him.

But let me just say that it’s pretty warped that someone can get two years in prison just for carrying a gun, something that’s perfectly legal in many (if not most) other places in this country. The only person Burress hurt was himself – now he’s got to do two years with actual, dangerous criminals? It’s only because politicians and prosecutors don’t like guns. This is one time when celebrity worked against a criminal suspect. If he’s been Plaxico Smith, the DA wouldn’t have been nearly as anxious to put him away, and would have been willing to cut a deal that included little or no jail time.

I don't know if I'm outraged or not
Plax, not the politicians and prosecutors, but himself in that position. Dude should have been home with his wife and kids, not in a club with AP and 44 with a loaded weapon “loosely” tucked in his jogging pants. I know the Steve Smith incident may have been in the back of his head but the law is the law. He broke New York’s law. Would have never happend if he were at home watching Law and Order.

First, if he was going someplace where he thought he might need a gun, he should have just stayed home. Second, even if the law is stupid, he should have known the law and left his gun at home. Third, he should have properly secured the gun – none of his would have happened if the gun hadn’t slipped. Still, the punishment doesn’t fit the crime.

I don't see anything to be outraged about
Plax discharged a firearm in a crowded night club. Fortunately he only injured himself, but his conduct was reckless and put others at risk. I don’t see two years as an outrageous punishment at all. It’s only a little more than half of what he might have gotten. I don’t think the law recognizes the stupid but lucky exception.

Actually, the law recognizes that to a great extent. If you’re driving drunk down an empty road, you’re only going to get a slap on the wrist – license suspension, fine, probably alcohol counseling, but no jail time. If you’re doing the same thing and a pack of nuns happen to be crossing the street and you plow into them, you’re looking at 10 years, minimum. Similarly, if you discharge a gun and shoot only yourself, you’re facing reckless endangerment and possession charges. If that bullet had killed someone else, that’s manslaughter and, probably, 7-10 years minimum.
The law treats reckless people who get lucky with their recklessness differently all the time. The only thing different here is that it was a celebrity carrying a gun in a city where the mayor and DA hate guns.

So Plax did take advantage of the stupid but lucky exception. That’s why there’s nothing outrageous about his sentence. I also don’t think there’s anything unreasonable about enforcing laws to keep idiots like Burress from carrying weapons in places where an accidental discharge could prove fatal. You can’t carry a gun on a plane either. NY is very tough on this issue, that’s why Burress’s celebrity didn’t buy him a free pass. It’s not that NY persecuted him for being a celebrity. Instead it treated him like anybody else.

New York City voters elected people who put these laws into place. The law is the law.
And I assure you, Plax is not being made an example of. This is what happens to people who get caught with unlicensed guns in New York City.

Simple possession of a firearm is a minor crime. A first offense doesn’t need to result in two years in jail. Probation, or a very short sentence, as well as revocation of any gun license and other collateral consequences, should suffice. I don’t think that would take us back to the Dinkins days – crime is down from those days because of more aggressive policing (among other things), not because Bloomberg is overzealously anti-gun.

That’s what probation is. Worthless.
Revocation of his gun license wouldn’t have worked, because he didn’t one.
And a simple way to avoid jail is to avoid breaking the law. He didn’t need a gun to sit in the VIP room of a midtown club. He was reckless and dangerous and could have killed somebody.
I’m all for being able to protect your home with a firearm, and a big advocate of 2nd amendment rights, but Plax wasn’t protecting his home, he was endangering the lives of everyone around him in a public place.

just cuz he shot himself doesn’t mean something worse could have happened. apparently the bullet almost hit a bouncer. obviously he did alot for the Giants, but he’s always felt that he was above the rest of the team and also above the law. 2 years may be a little steep, but his outlaw mentality had to backfire eventually…no pun intended

What happened to Vick and Stallworth is apples to oranges. Burress just won the SB and earned himself a fat new deal—he had everything going for him. You can’t compare the different situations. If Vick or Stallworth had been tried in NYC whose to say what their sentences would have been.
Heck if any of them had been tried in California they probably would never have served any time at all.

Plax played injured during the 2007 season and helped the Giants win a Super Bowl. Gutsy.
He brought a loaded gun with no safety into a crowded club serving alcohol. Stupid. He could have killed someone by accident.
Plax never grasped the reality of the trouble he was in – expected to escape some how. Out of touch.
Plax did this to himself. He is not special. This is really sad, but fair. He has no one to blame but himself.
This makes me really sad.
Partly because he made a serious error in judgement in the first place, but mostly because he egregiously compounded it by not taking the deal he had on the table last spring (or whenever that was) which would have enabled him to serve his time over the summer, come out and rejoin the Giants. What terrible fking advice he got – or maybe what a terrible mistake not listening to better advice, if he got it.

Reese was ready to hold up his end of the deal that Plax had already signed. I forget the exact terms of the extension Plax signed but Reese was ready to honor up until the point where Plax refused the plea bargain.

on the table that would have allowed him to serve only 3 months? I can’t imagine that if there were, he would have been so dumb as to turn it down. Then again this is Plax we’re talking about.
And TWO years means they really put the last nail in the coffin of his career.
I understand it’s the law and that he put himself in the position, it just seems a terrible waste – of his talents, of his ability to provide for his family, of his dignity (I’m sure bankruptcy’s looming for him too)
I just hope that this is Exhibit A at the next rookie symposium so that the next wanna-be heat-packing tough guy can understand how easily this can ruin your entire life, and he can trun himself into a better person from looking at the ruins of Plax’s career. Then maybe some good can come of this

Never wanted him. Acorsi..told Coughlin that if he couldn’t deal with a problem player, he shouldn’t be a coach..that is the only reason he played on the team. He pretty much sucked mostly. I do think he got a raw deal though.

An old guy in Brooklyn (I think Brooklyn)..
Shot and killed two and wounded two more this past week..It was a shotgun he used to defend his employees from being pistol whipped and robbed..He owns a restaurant supply business. It’s the same all over the country..So much for NYC’s gun laws..Read up on the real news and then come back and tell me that a guy who almost shot his own balls off because he was stupid enough to pack a gun for whatever reason (his own protection?..lol) deserves two years in jail.,,and don’t feed me that crap about local vs. federal shit..If you think it is okay for laws to be inconsistent from state to state then you are an idiot..The federal government has nothing to do with what the state Governor conventions come to agreement on regarding the law on DUI and Guns, etc…and in Florida just so you know if you commit habitual crimes you go to the big house for life. If you kill someone you will get killed back. Florida’s DUI laws are no different than any other state in the union..Somehow Stallworth got off with money and thirty days. How can you possibly proclaim that.. that it is less worse than Plaxico almost shooting his own balls off?

this guy bothered read the law
and had a shotgun, which doesn’t have to be licensed. I’m not a fan of the Sports Jerk tone, but he’s spot on this issue.
I come at this issue from a different perspective. I’m an African-American male and we’re become an endangered species in big part all the gun play. These laws are meant to save people from getting killed, the public here supports them, and Plax broke them and had to pay a heavy price. Maybe he should take his gun in the club act to South Beach where they’d wrist slap him.

We live on the beach..He’d have to look for us there
..and I have an arsenal..including
..a licensed 40cal Glock..Mine has a safety however, and I don’t wear sweatpants..My beer is in the fridge, hence I don’t need to go to bars. If I do go out it is with my wife or my wife and kids..and the Glock stays home locked up.

Aw, just a little Father and Son spat..no big deal..He is a good kid..well intentioned…Plus he loves the Giants..Has alot going for him!..Yeah Ochocinco was kicking his entire football career..but he is another nutty guy that just doesn’t fit in a Giants jersey..He’s really good, but a major distraction from a team perspective. I think our receiving crew will do well this year..and man do I love this Barden..what a specimen..He even makes Plax look like a dwarf!
Barden is going to be special but I’m really rooting hard for Nicks because I live in NC and he is a Tarheel.

He’ll want to avoid the possibility of getting beat up. He doesn’t want to have to join a gang or anything like that. Then again, who knows with these mental cases. Maybe he’ll get lonely in seg and ask to be put in the general pop. In which case, anything goes. But usually when rich guys go to prison, they load up from the commissary with crud like TV, radio, etc., and don’t come out of the cell much anyway.
Ed, you should get in touch with him while he’s in and get an interview. He’ll be ahppy for the company.

“Good time” and “Transitional supervision” do not apply to violent crimes. I don’t know the actual charge he pled to, but if it’s a solid firearm charge I bet he does 85% of the time.

celebrity yes,
he could be popular in gen. pop.
But I doubt he’ll be there, and a few reasons are:
1. at 6’6" 230, he won’t be the biggest guy around
2. prisons are gang-dominated and 1-on-1 fights are rare.
3. you’re assuming the mentality of non-criminals that wouldn’t fight the guy. There’s a lot of dumb guys in prison who do very few things well (and fighting is often one of them.)
One summer I spent in County, the three toughtest guys had to be about 6’4", 240 hulkish, 6’2" 320 fatty, and 5’5" 170 a little tank. Honestly I woulda bet on the short guy. He was unstoppable, I thought he was going to break my arm the one time we got into it.
Lastly, there’d be pressure on him to join a gang.

He wife is a lawyer, it was his gun and you have to pull the trigger of a glock in order for it to go off, for anyone who doesn’t own a glock and he got less then what the law states…
If an Athlete gets off its becuase he is rich and famous and everyone is mad, if they get thrown in jail its because the “MAN” is holding him down… Makes sense, i guess it was better in the old days when noone found out cause the cops let him go..
I for one am glad he is in jail… he is a DUMBASS and deserve it..

not that i am a plaxico burress fan, but how does a guy shoot himself in the leg, and get 2 years in jail, and another guy spends a lifetime literally torturing and killing defenseless animals, financing a whole operation of it over state lines later in life, and only get 18 months…something is wrong here

The comparison between Vick and Burress is silly. IMO what Plax did was worse cause it endangered peoples lives. Nightclubs are dark and people are dancing and drinking. What happens if someone had bumped into him or the bullet bounced another direction? Ask Shyne and Puffy about the shit that can happen when people bring guns and alcohol together. Plus the Feds dealt with Vick under their system and Plax was NY jurisdiction.
Another thing about Cheddar Plax. He almost bought Antonio Pierce and his own wife obstruction of justice charges with his nonsense on top of what he did. Plax is paying a steep price, but I can’t say he doesn’t deserve it.

sure, every situation is unique. But if you want to talk about poor judgement vs. carefully planned and long-term executed viciousness and sadistic cruelty in the name of profit, Plax wins this one. I hate it when the Vick thing gets called a mistake. Running an interstate crime ring is not a mistake.

What if one of Vick’s dogs got loose and ran into some kids? You don’t think that was endangering peoples lives. Fact is, every single day people do stuff that endangers other people. The other day I almost started a fire cooking with grease – that fire could have burned down my apartment building. Should we outlaw cooking and put me in jail for 2 years for it? Plax was already punished for carrying a gun, when he SHOT HIMSELF IN THE LEG. 2 years in jail is a waste of taxpayer money to prove a point.

He had a great lawyer, too, who might have been able to get a good deal from the get-go. I think his problem was that he jerked the LEOs around from day one and didn’t stop until he ran out the clock. He had the DA’s office foaming at the mouth, including Morgenthau himself, not to mention Bloomberg. Plax remained in character throughout
and got poleaxed for it.
Being a celebrity didn’t help him or Vick. Both received punishments far in excess of those who commit more serious crimes (e.g., child molesters. Where’s the proportionality? I’m not surprised by flaws in our judicial system (or any for that matter.)
I agree with this. The problem with a lot of athletes is people overlook a lot when your one. They are used to getting off light. Even the Giants at times let Plax off the hook for stuff lessor players would have gotten cut for. They get used to it. Today Plax learned they are rules and limits even for football stars.

But the Giant’s brass tried..they fined him what 40 times?..He has a major problem with authority, now he has no choice but respect it..I don’t think for a micro-second that any of us regular joes on this site or anywhere..would even get 40 chances to keep our job..We’d all be out on the street with pink-slips.
Maybe the 20 months
in jail will finally allow Plax to straighten out his life…and hopefully at 34 he’ll be able to play again. Afterall, football is where his skills lie..Although he is tall enough to change light-bulbs without a ladder.
